These Terms of Service (hereinafter referred to as the "Terms") set forth the conditions applicable to the services provided by the Company (hereinafter referred to as the "Service") on the website (hereinafter referred to as the "Site") provided by Japan Toreca Center Inc. (hereinafter referred to as the "Company"), as well as the rights and obligations between the Company and Service Users (as defined in Article 1, Item 3). The Terms shall also apply to any separate rules established by the Company with respect to the Service.

In the Terms, the terms listed in the following items shall have the meanings set forth in each such item.
"Japan Toreca Center" means the site provided by the Company (https://japan-toreca.com/).
"Service Use Agreement" means an agreement concerning the use of Japan Toreca Center.
"Service User" means a person who has entered into a Service Use Agreement with the Company.
"Account" means the information concerning a Service User that the Service User has registered with Japan Toreca Center.
"Password" means the code consisting of a combination of alphanumeric characters created by the Service User themselves.
"Email Address" means the email address that the Service User has registered for the Service.
"Coins" means the virtual currency that a Service User may use within Japan Toreca Center.
"Products" means the cards that can be obtained through the games within Japan Toreca Center.
The contents of Japan Toreca Center and the procedures for its use shall be as described in the "Notation Based on the Act on Specified Commercial Transactions" separately established by the Company.
The Company may, at its own discretion, change the contents of Japan Toreca Center or terminate its provision at any time.
Service Users may not object to, or claim damages or make any other claim in respect of, any change to the contents of Japan Toreca Center or any termination of its provision by the Company.
If the provision of Japan Toreca Center is to be terminated, the Company shall notify Service Users in advance by a method determined by the Company.
Service Users must use Japan Toreca Center in accordance with the provisions of the Terms, and may not use Japan Toreca Center unless they agree to the Terms.
At the time a Service User completes the procedure for agreeing to the Terms on the registration screen of Japan Toreca Center, a use agreement in accordance with the provisions of the Terms (hereinafter referred to as the "Use Agreement") shall be formed between the Service User and the Company, and the contents of the Terms shall become the contents of the Use Agreement.
The Company shall bear no liability whatsoever even where a Service User suffers a disadvantage, such as being unable to use the Service due to unavoidable circumstances including server errors, when using Japan Toreca Center.
If a person who wishes to use Japan Toreca Center is a minor, an adult ward, a person under curatorship, or a person under assistance (hereinafter referred to as a "Minor or Similar Person"), such person shall obtain in advance the consent of a legal representative such as a person with parental authority before using the Site. However, if a Minor or Similar Person has agreed to the Terms, such person shall be deemed to have obtained the consent of their legal representative. Furthermore, notwithstanding the provisions of this item, if it comes to light that a Minor or Similar Person is using the Site without the consent of their legal representative, the Company may take some or all measures such as suspending the user's use of Japan Toreca Center or terminating the Service Use Agreement, without prior notice to such Minor or Similar Person.
The Company may decline an application for use, and in such case the Company shall bear no obligation to disclose the reason therefor. In addition, where an applicant for use has previously registered and withdrawn, or where there is a risk thereof, and the Company determines that such registration or withdrawal was inappropriate, the Company may decline the application for use.
The Company may decline an application for use, and in such case the Company shall bear no obligation to disclose the reason therefor.
An applicant for use of Japan Toreca Center must not transmit inaccurate or false information when applying for use.
The Company shall bear no liability for any impediment to the use of Japan Toreca Center arising from an error in Account information or from a delay in, or deficiency of, a change thereto.
The Terms and the Coin Terms of Use set forth the arrangements between the Company and Service Users with respect to the use of paid services on "Japan Toreca Center", which the Company develops, operates, and provides.
A Service User may terminate the Use Agreement at any time by carrying out the cancellation procedure on Japan Toreca Center or any other cancellation procedure separately established by the Company.
Service Users must prepare, at their own expense and responsibility, the devices, communication equipment, software, agreements concerning connection to the internet, and other arrangements necessary to use Japan Toreca Center.
The Company is in no way involved in, and bears no liability whatsoever for, the environment in which a Service User uses Japan Toreca Center.
By registering their own email address at the time of registration, a Service User may use it as their email address on Japan Toreca Center. Please note that email addresses cannot be changed within the Site; therefore, if a Service User has registered an incorrect email address, or wishes to change their email address, the Service User must make an inquiry by email and complete the change procedure.
As a general rule, a Service User may hold only one Account per person and per address; Service Users may not hold multiple Accounts and must not repeatedly register and withdraw without reasonable cause. If it comes to light that a Service User holds multiple Accounts, the Company shall delete the Accounts held by such Service User without prior notice. In such case, all Coins charged to the deleted Accounts shall lapse.
If the Company determines that the operation of Japan Toreca Center is difficult, the Company may restrict a Service User's use of the Service until the relevant cause is resolved.
Service Users shall register and manage, at their own responsibility, the information registered for use (including email addresses, IDs, and passwords; hereinafter referred to as "Registered Information"). Service Users must not allow any third party to use their Registered Information, nor lend, transfer, change the name on, sell, or purchase such Registered Information.
Where Japan Toreca Center has been used with the Registered Information, the Company shall deem such use to have been made by the person who registered for use, and the results arising from such use, together with all liability accompanying it, shall be attributable to the person who registered for use.
If damage is caused to the Company or a third party by the unauthorized use of Registered Information, the Service User shall compensate the Company or such third party for such damage.
Management of Registered Information shall be carried out by the Service User at their own responsibility, and the Company shall bear no liability for any disadvantage or damage suffered by a user as a result of Registered Information being inaccurate or false.
Registration for use of the Service (hereinafter referred to as "Member Registration") must be carried out by the user themselves, and the user must enter accurate information (hereinafter referred to as "Member Information").
This agreement shall be formed when the Company approves the Member Registration.
Upon completing Member Registration, a user is deemed to have agreed that they have provided accurate information about themselves and that they will not use a false name or age or an unauthorized payment method.
Except where separately and expressly permitted by the Company, Service Users must not engage in any of the acts listed in the following items in connection with their use of the Service.
Acts that violate laws or regulations
Acts that violate the Terms
Acts that unjustly cause disadvantage or damage to the Company or a third party
Use of any function of Japan Toreca Center for a purpose other than its intended purpose
Infringement of the intellectual property rights of the Company or a third party
Infringement of the privacy or portrait rights of the Company or a third party
Disclosure of confidential information of the Company or a third party
Provision to third parties of information that can be viewed within Japan Toreca Center
Provision of the personal information of a third party without that person's consent
Slander or defamation of the Company or a third party
Acts against officers or employees of the Company, or persons equivalent thereto, that deny their dignity or otherwise exceed the scope reasonably accepted by society (including, but not limited to, intimidating, threatening, or menacing acts; insulting remarks or remarks denying a person's dignity; acts infringing privacy; demands for the provision of services that are excessive by social standards; demands for apologies or punishment without reasonable grounds; acts of confining staff for long periods by excessively repeating the same requests or complaints; and acts of slander or defamation on the internet)
Damage to the reputation or creditworthiness of the Company or a third party
Impersonation of the Company or a third party
Use of the Account information of a third party
Alteration or deletion of information recorded in the systems used to provide Japan Toreca Center
Transmission of harmful computer programs or the like
Obstruction of the provision of Japan Toreca Center or of any other business operations
Circumvention or removal of the access control functions configured for Japan Toreca Center, or any other unauthorized access
Fraudulent means such as obtaining information from the Company or a third party
Excessive repetition of inquiries to the Company, or coercing the Company into responses it has no obligation or reason to provide
Acts that facilitate any of the acts listed in the items above, such as by selling equipment, providing information, or setting hyperlinks
Acts that risk falling under any of the items above
Any other act that the Company determines to be inappropriate
The Company shall bear no liability whatsoever even where a Service User or a third party suffers disadvantage or damage in connection with the provision of various information in the Service or otherwise in connection with the Service. This shall not apply, however, where such disadvantage or damage arises from the Company's willful misconduct or gross negligence.
The Company shall bear no liability whatsoever for any disadvantage or damage caused to a Service User or a third party where, due to unavoidable circumstances such as congestion of communication lines, unforeseen system accidents, or bugs, the confirmation of whether a purchase of Coins or the acquisition of a Product has succeeded, or the notification thereof, is significantly delayed, or where such purchase or acquisition becomes impossible. In addition, where a price is displayed incorrectly due to such circumstances, the Company may request the Service User to settle the difference between the incorrectly displayed price and the correct price.
Service Users agree that their personal information will be handled in accordance with the "Privacy Policy" separately established by the Company.
Intellectual property rights and other rights relating to the content and information provided by the Company to Service Users through Japan Toreca Center belong to the Company or to third parties that have licensed such rights to the Company.
A Service User may, by the method prescribed by the Company, purchase Coins usable only within the services provided by the Company, at the amount presented by the Company within Japan Toreca Center or in other services provided by the Company. The Company may establish purchase conditions for Service Users concerning the purchase of Coins, such as purchase units, payment methods, usage periods, and age restrictions, and the purchase conditions and payable amounts so established shall be posted within Japan Toreca Center. Where an age restriction applies and it comes to light that a Service User has purchased age-restricted Coins despite not having reached the age designated by the Company, the Company may take some or all measures such as suspending the user's use of Japan Toreca Center or terminating the Service Use Agreement, without prior notice to such Service User.
The validity period of Coins shall be within six (6) months from the date on which the Coins were purchased or granted. Coins obtained by waiving the right to acquire a Product shall be granted with the same validity period as that of the Coins used to acquire such right.
Service Users shall pay fees for paid services (including any other obligations incurred by the Service User through paid services) in accordance with the payment methods and conditions separately established by the Company. Except where the Company bears legal responsibility, such as where it is at fault, the Company shall not refund any such fees paid by a Service User.
A Service User may receive delivery of Products obtained through the use of paid services.
A Service User may hold the Products they have obtained, and if they wish to have them shipped, must complete the prescribed shipping procedure on the Service by the shipping deadline individually specified on the Service for each Product (hereinafter referred to as the "Shipping Deadline").
A Service User agrees that, if they do not complete the shipping procedure under the preceding item for a Product they have obtained even after the Shipping Deadline has passed, shipping cannot be selected for the won Product, the Product will be automatically exchanged for Coins by the Company, and a time lag of several hours may occur before the result of such Coin exchange is reflected.
With respect to shipping-only Products for which no exchange into Coins is provided, if a Service User does not complete the shipping procedure under Item 2 even after the Shipping Deadline has passed, the Service User shall lose the right to receive delivery of the Product (the right to acquire the Product), and the Company shall bear no liability to compensate for any damage resulting therefrom.
Where it becomes clear that delivery of a Product obtained by a Service User is impossible for reasons attributable to the Company, the Company shall be released from its liability for damages by granting to the Service User the Coins that the Service User used to acquire such Product. The Company shall bear no obligation to obtain a Product identical to such Product and deliver it to the Service User.
Shipping fees relating to Products shall be borne in full by the Company. However, for shipping outside Japan, a separate fee corresponding to each country shall be collected.
When shipping a Product, the Company shall package it by an appropriate method so that damage to the Product does not occur.
As for the timing of delivery, the Company shall commence the procedure from time to time once it determines that the shipping request has been made by the Service User themselves.
Where the Company determines that there has been fraud or impropriety, the Company may contact the Service User.
The Company shall bear no liability whatsoever even where trouble such as damage occurs while a Product is being shipped.
Where any act by a Service User in breach of the Terms is found before delivery of the relevant Product, the Company may suspend delivery of the Product. The Company shall bear no liability to compensate for any damage resulting therefrom.
The Company may determine the shipping method for Products (including mail restricted to delivery to the addressee) at its own discretion. If, after the Company has shipped a Product to a Service User, the Product is returned due to refusal of receipt, an unknown address, or the like, and the Service User does not complete the re-shipping procedure, the Service User shall lose all rights relating to such Product. Even in such case, the Company shall bear no obligation to return Coins or provide any other compensation or damages whatsoever.
The Company will not respond to any inquiries from Service Users regarding delivery dates or the like.
Where the number of shipments is large, or where other operations are in progress, the deadline in Item 2 may be exceeded without notice.
On Japan Toreca Center, Product names and Product images are linked to each other; in the unlikely event that a Product image does not match the Product name, the Product associated with the Product name, rather than the Product image, shall take precedence.
To purchase a Product, entry of a billing and shipping address, SMS verification, date of birth, and legal name is required.
Where a Product transaction is concluded contrary to the Company's intent on the basis of an erroneous description on the Site, the Company may cancel or rescind such transaction, suspend delivery, request the return of the Product, and take other necessary measures.
The Company does not guarantee the authenticity of any third-party appraisal results relating to a Product, and shall bear no liability whatsoever even where doubts or trouble arise from such appraisal results.
On Japan Toreca Center, a Service User may purchase Coins by using a credit card payment method, or, within other services provided by the Company, by using the method specified within Japan Toreca Center. However, the credit card used for payment must be held in the Service User's own name and be valid at the time of payment.
Where a Service User uses credit card payment, the Service User shall register, by the method designated by the Company, the information relating to the credit card held in that Service User's own name (the type of credit card, card number, expiration date, and the like; hereinafter collectively referred to as "Credit Card Information").
The Company shall bear no liability whatsoever even where a Service User suffers damage due to an erroneous registration of Credit Card Information or the like. In addition, where the Company suffers damage due to a Service User's falsehood or fraud relating to the use of a credit card, such Service User shall compensate the Company for all damage suffered by the Company.
When settling fees incurred for the use of Japan Toreca Center by credit card, the Company shall, by the prescribed method, request approval from the credit card company as to whether payment is possible with the credit card used by the Service User for such payment, and may decline to process the payment if such approval is not obtained. Even where damage is caused to the Service User in such case, the Company shall bear no liability whatsoever for such damage.
Even after a Service User's credit card payment has been completed, if the credit card company notifies the Company of a refusal or suspension of the use of such credit card, or if a falsehood or fraud by such Service User relating to the use of the credit card comes to light, the Company may suspend all payments by such Service User, for any reason whatsoever.
A Service User may purchase Coins usable in the Service within other services provided by the Company. In such case, however, the purchase must be made using the same Account as for the Service. Service Users acknowledge that if they purchase Coins using a different Account, the Coins will not be reflected within Japan Toreca Center and cannot be used. In such case, the Company shall provide no refund whatsoever and shall bear no liability whatsoever.
Where a dispute arises between a billing settlement company or payment agency used by the Company and a Service User over fees for Japan Toreca Center or other monetary obligations, such dispute shall be resolved between the Service User and such company, and the Company shall not be involved in the dispute in any way and shall bear no liability whatsoever.
In any of the following cases, the Company may temporarily suspend the provision of all or part of Japan Toreca Center without bearing any liability for damages or other obligations.
Where maintenance or inspection of the equipment used to provide Japan Toreca Center is carried out
Where the provision of Japan Toreca Center is impeded by fire, power outage, or the like
Where the provision of Japan Toreca Center is impeded by a natural disaster such as an earthquake, volcanic eruption, flood, or tsunami
Where the Company determines that, for operational reasons, it is necessary to temporarily postpone or interrupt the provision of Japan Toreca Center
Where the Company determines that a user of Japan Toreca Center falls under any of the following, the Company may proceed with the suspension of use of the Service, the termination of the Service Use Agreement, or other procedures, without prior notice to the Service User. 1. Where a third party has made unauthorized use of Japan Toreca Center as a result of the leakage of a Japan Toreca Center user's password. 2. Where the Company determines that a Japan Toreca Center user's conduct will impede the Company's business. 3. Where multiple Accounts have been obtained, or where the Company determines that there is a risk thereof. 4. Where the Terms have been violated. 5. Where, in addition to the preceding items, the Company determines that it is necessary to carry out use restriction procedures.
Where a Service User violates the prohibited act set out in Article 8, Item 11, the Company may contact the police, an attorney, or the like and take appropriate measures.
Even where the Company carries out use restriction procedures and damage is caused to a Service User, the Company shall bear no liability whatsoever for such damage.
Where a Service User's Use Agreement is terminated, the Service User shall lose the benefit of time with respect to their obligations owed to the Company and must immediately perform all obligations owed to the Company.
The Company and Service Users represent and warrant the following.
That neither they nor their officers, employees, shareholders, or de facto managers are members of an organized crime group (meaning a boryokudan, a member of a boryokudan, a person for whom five (5) years have not elapsed since they ceased to be a member of a boryokudan, a quasi-member of a boryokudan, a boryokudan-related enterprise, a sokaiya, a group engaging in criminal activities under the pretext of conducting social campaigns, a crime group specialized in intellectual crimes, or any person equivalent thereto; the same shall apply hereinafter); that they do not conduct transactions with organized crime groups; that they do not cooperate with or participate in the maintenance or operation of organized crime groups through the provision of funds or other acts; and that they have no other intentional interaction with organized crime groups.
That they will not, either themselves or by using a third party, engage in violent or threatening acts such as assault, injury, intimidation, extortion, or coercion against the other party, nor make demands using fraudulent methods such as spreading rumors or employing deception, nor make unjust demands exceeding a reasonable scope, nor obstruct business, nor damage reputation or creditworthiness.
The Company may change the Terms where it determines this to be necessary. In such case, the Company will give notice, by posting on the Company's website or by another appropriate method, of the fact that the Terms will be changed, the contents of the revised Terms, and the effective date thereof.
Even where a Service Use Agreement has terminated, the Service User shall not be released from obligations that arose before the termination of the Service Use Agreement.
With respect to matters not provided for in the Terms, or where doubt arises as to the interpretation of the Terms, the Company and the Service User shall, in accordance with the principle of good faith, consult with each other and seek a prompt resolution.
The Terms shall be governed by the domestic laws of Japan. Any dispute between a Service User and the Company relating to the Terms or a Service Use Agreement shall be subject to the exclusive jurisdiction of the Yokohama District Court as the court of first instance.
